  • Sanjay Dutt’s Review Petition Rejected

    Sanjay Dutt’s Review Petition Rejected

NEW DELHI: Today, 10 May, in the Supreme Court, actor Sanjay Dutt submitted his plea to review his case where he has been convicted to serve a jail term of 5 years. It was rejected.

Previously, a bench of judges hearing the case, delivered the verdict on 21 March, earlier this year. He was granted a relief of four weeks to surrender. He used the time to complete some of his film assignments. He has spent a year and a half in jail before. The remaining three and a half years is his jail term that he has to serve from 16 May.

Now with the dismissal of his plea review today, the actor can file a curative petition. Its his one last chance to try again before 16 May. After that, his only hope is to apply for a mercy petition to the President of India. If that happens, and he is given a pardon, it will shake the present government of the country which is already facing flak for being lenient with his case.

The apex court has also rejected the similar pleas filed by other six convicts – Yusuf Mohsin Nulwalla, Khalil Ahmed Sayed Ali Nazir, Mohamed Dawood Yusuf Khan, Shaikh Asif Yusuf, Muzammil Umar Kadri and Mohd Ahmed Shaikh.

On 17 April, the Supreme Court had granted Dutt, 53, four weeks time to surrender. The apex court had on March 21 upheld his conviction in the 1993 Mumbai serial blasts. The actor’s close links to underworld don Dawood Ibrahim and others with the involvement of Pakistan’s ISI was investigated.

However, the apex court has reduced his six-year jail-term to five. The TADA court in 2006, had ruled out his release on probation saying the “nature” of his offence was “serious”.

Dutt is booked by the TADA court for illegal possession of a 9 mm Pistol and a AK-56 rifle which was in a consignment of weapons and explosives brought to India for serial blasts that killed 257 people and injured over 700.

  • Sanjay Dutt Isn’t Pleading For Pardon, But Justice Katju Will

Sanjay Dutt Isn’t Pleading For Pardon, But Justice Katju Will

MUMBAI: Bollywood Actor Sanjay Dutt addressed the media from his residence earlier today for the first time since the verdict under the Arms was passed against the actor.

A very emotional Sanjay Dutt said that he will surrender to 5 years imprisonment and will not be seeking pardon.

“I am a law abiding citizen. I have the highest respect for the Supreme Court. I will abide to all terms and conditions. I will surrender at the time given. I have not applied for any pardon. There are many other people who deserve pardon. I want to tell with folded hands to the media, the honourable citizens of the country that when I am not going for pardon then there can be no debate about it.” said Dutt.

There have been many debates over whether the actor was judged too harshly and whether or not Dutt should be pardoned. While Bollywood has been unanimous in asking for a pardon, support has also been building for the actor in political circles.

Even as Dutt said that he will not seek pardon, Press Council of India (PCI) Chairman Justice Markandey Katju said that he will still seek pardon for Sanjay Dutt and 1993 Mumbai blasts case convict Zaibunisa.

“I will appeal for Dutt and Zaibunisa’s pardon. It’s true that it was a grave offence and the court has given the right judgement. Sanjay has done some foolish things as a young man, but he is a changed man now and I will appeal for his pardon,” Katju said.

When asked on what grounds he was demanding a pardon, Justice Katju said: “Public good is one of them, there can be many other considerations like humanitarian considerations for grant of pardon. If you study the Articles 72 and 161 of the Constitution, they do not state that who can appeal. Section 72 provides power to the President to pardon and section 161 to the governor. But both sections do not state that who can appeal and it is not written on what grounds pardons can be given. There could be thousands of ground for a pardon.”

Justice Katju also cleared that he had issued his appeal for Dutt without having spoken or interacted to the actor in any way.

“I have not talked to Sanjay Dutt, I have not contacted him, and he has not approached me. In my first appeal which I issued for pardon, I did it without contacting him.” Justice Katju said.

“Right now, I am a shattered man, my family is shattered. There have been very though moments in my life and in our lives (his family). I want to thank everybody who supported us and me. I just want to tell everyone from the media that I have got very few days left and I want to finish all my work. I also have to spend time with my family,” Dutt said.

  • The Pleas Turn Louder As Bollywood Pushes For Sanjay Dutt’s Pardon

The Pleas Turn Louder As Bollywood Pushes For Sanjay Dutt’s Pardon

    More photos

NEW DELHI: Two days after the Supreme Court sentenced Sanjay Dutt to five years of jail under the Arms Act in relation to the 1993 Bombay blasts, Bollywood continues to proactively plead for the actor’s mercy.

Dutt was originally charged with five offences, which included criminal conspiracy and possession of illegal weapons. The designated trial court found him guilty of illegally possessing a rifle and a pistol but cleared him of conspiracy.

The son of a Hindu father and Muslim mother, Dutt said the weapons were necessary in order to defend himself and his family during the Hindu-Muslim riots of 1993.

The Supreme Court reduced Dutt’s jail term of six years, sentenced by the TADA court in 2007, to five years. The bollywood actor, who has already served 18 months in jail and is currently out on bail, is expected to surrender within the next four weeks to serve a jail term of 42 more months.

The 53-year-old bollywood actor said that he was ‘shattered and in emotional distress’ as he has suffered for the past 20 years. “I am heartbroken because today along with me, my three children and my wife and my family will undergo the punishment,” said Dutt in his statement.

Press Council Chief Justice Markandey Katju wrote a letter requesting Maharashtra Governor K. Sankarnarayanan to pardon Sanjay Dutt the five year sentence. Katju sought pardon for Dutt under Article 161 of the Constitution saying that actor had “already suffered a lot”.

Yesteryear Bollywood actress and Samajwadi Party MP Jaya Bachchan too has come forward in support of Sanjay Dutt. She says she will appeal to Maharashtra governor K Sankarnarayanan to pardon him. “I agree with everyone that he has suffered a lot. I believe that he should not be given such a big punishment. He is a changed man now. I’m going to personally appeal to the governor and ask him to pardon him,” said Jaya.

There is no doubt that the Maharashtra Governor can grant pardon or reduce Dutt’s sentence. But does he really deserve it?

The arguements in favour of the actor are: In the past 20 years that Dutt has been out of jail he has shown good conduct and has been involved in various charitable activities. He is on the board of directors of Save the Children Foundation. He has been very respectful of the court and has obliged to all the requirements such as taking the court’s permission every time he had film shootings abroad. His parents Sunil Dutt and Nargis Dutt used to do good social work.

However, while Bollywood continues to rally, there are many from the law enforcement and political arena, who question- “What has Sanjay Dutt really suffered from the past 20 years? He’s been out on bail, regularly travelling abroad, making movies, making money – where’s the suffering exactly?”

An exception to the emotional film fraternity, filmmaker Mahesh Bhatt clearly says that Sanjay “should be man enough” to accept the verdict and face the punishment meted out to him. Former IPS officer-turned-lawyer YP Singh has little sympathy for Dutt who he feels has clearly benefitted from the advice of professional image managers to evoke public sympathy and project himself as a victim of circumstances.

But there is no stopping the staunch plea of a “pardon” from Bollywood. From newbies to veterans the protest continues…

“I was very disturbed when I heard my friend and a lovely person Sanjay Dutt’s verdict. The current support and appeal for his pardon is giving me hope. I pray to god that he gets remedy and spends at least the rest of his life peacefully,” said Tamil super star Rajnikanth.

Writes Ajay Devgn, “Acquitted of TADA & all conspiracy charges. The only charge against him is the possesion of arms. The man has served 18 months and sat in trial for 20yrs. Sanju has been a model citizen thereafter. He may not be blameless but I think he has paid the price for his foolishness! What about you?”
